Privacy Policy

Last updated on August 18, 2009.

We are committed to safeguarding the privacy of our website visitors; this policy describes how we treat your personal information. In general terms, we follow the guidelines suggested by Canada’s Personal Information Protection and Electronic Documents Act (”PIPEDA”).

1. Accountability

Gossamar and its employees are responsible for personal information under our control. We are thus accountable for our compliance with this Policy and all applicable privacy laws. When we use trusted third parties to act on our behalf by performing such functions as delivering packages, or processing credit card payments, contractual or other appropriate means are used to ensure compliance by such third parties with this Policy and all applicable privacy laws.

This Privacy Policy applies solely to information collected by us.

2. Identifying Purposes

Unless the purpose is self-evident due to the nature of the transaction in question, we will identify the purposes for which personal information is collected at or before the time the information is collected.

The proposed purposes will be described in a reasonably understandable manner.

An example of a self-evident purpose is requesting the name and address of the person requesting to download an item of our Online Content.

3. Consent

We will collect, use or disclose your personal information only with your knowledge and consent, except where required or permitted by law.

With your explicit consent, given when you provide personal details, AND when you click on the Permission Box displayed on the form collecting them, we will email you newsletters and promotional materials from time to time. You may choose to unsubscribe from these contacts at any time by clicking on the unsubscribe link.

4. The Information We Collect

We may collect, store and use the following kinds of personal data:

  1. information about your visits to and use of this website such as your IP address, geographical location, browser type, referral source, length of visit and number of page views
  2. information about any transactions carried out between you and us
  3. information that you provide to us for the purpose of registering with us and/or subscribing to our website services and/or email notifications.

We may use the information we collect in the administration of this website, to improve the website’s usability, and for marketing purposes.

In addition to the uses identified elsewhere in this privacy policy, we may use your personal information to:

  1. improve your browsing experience by personalizing the website
  2. send information to you which we think may be of interest to you by post or by email or similar technology
  3. provide other companies with statistical information about our users – but this information will not be used to identify any individual user.

We use cookies on this website. A cookie is a text file sent by a web server to a web browser, and stored by the browser. The text file is then sent back to the server each time the browser requests a page from the server. This enables the web server to identify and track the web browser.

Most browsers allow you to refuse to accept cookies. For example, in Internet Explorer you can refuse all cookies by clicking “Tools”, “Internet Options”, “Privacy”, and selecting “Block all cookies” using the sliding selector. This will, however, have a negative impact upon the usability of many websites, including this one.

5. Security of Your Personal Data

We take reasonable precautions to prevent the loss, misuse or alteration of your personal information. Of course, data transmission over the Internet is inherently insecure, and we cannot guarantee the security of data sent over the Internet.

We store all the personal information you provide on our secure servers. Gossamar also stores your login and password information to the Pardot PI Demand Generation system, to allow you to easily login to the software when you wish to use the service.  This information is encrypted for security and is used solely to provide a connection between you and Pardot PI and will not be shared with any other entity.

6. Products and Clients

Gossamar uses software from various vendors to supply its service to you. Your data will thus reside on one or more of these supplier’s websites in a carefully administered database with suitable privacy protection mechanisms in place. Your information with these suppliers is covered under separate Agreements between Gossamar Inc. and these suppliers – copies of such Agreements will be made available to you on request.

7. Third party websites

The website contains links to other websites. We are not responsible for the privacy policies of third party websites.

8. Limiting Use, Disclosure, and Retention

We do not sell or rent customer lists or personal information to others. However, we may release your information to outside parties in certain circumstances, which include:

We give a limited amount of information, only as necessary, without your consent, to our suppliers and agents. These suppliers and agents may be located in Canada or other jurisdictions or countries, and may disclose information in response to valid demands or requests from governments, regulators, courts and law enforcement authorities in those jurisdictions or countries.

When required or permitted to do so by law or applicable regulators and self-regulatory organizations.

We may release information in response to a search warrant, court order, or other demand or enquiry which we believe to be valid. This may include requests from regulators, including self-regulators, who are responsible for ensuring we are in compliance with applicable regulations.

9. Safeguards

We will protect personal information by security safeguards appropriate to the sensitivity of the information, including through the use of physical measures (e.g., locked filing cabinets, restricted access, appropriate disposal of personal information), organizational procedures (e.g., security clearances, access only on a “need to know” basis) and technological processes (e.g., passwords, encryption).

10. Openness and Policy Amendments

Information about our policies and practices relating to the management of personal information will be made readily available to individuals. We may update this privacy policy from time-to-time by posting a new version on our website. You should check this page occasionally to ensure you are happy with any changes.

11. Individual Access and Accuracy of Data

Upon request, we will inform you of the existence, use and disclosure of personal information relating to you, and give you access to that information. You have the right to challenge the accuracy and completeness of your information and have it amended as appropriate.

Your personal information will be as accurate, complete and up-to-date as you keep it.

However, in certain circumstances permitted by law, this information will not be disclosed to you. Some examples of these circumstances are information that contains references to other individuals, that cannot be disclosed for legal, security or commercial proprietary reasons, or that is subject to solicitor-client or litigation privilege.

We do not knowingly collect or solicit personal information from anyone under the age of seventeen or knowingly allow such persons to register. If you are under the age of seventeen, please do not attempt to register or send any information about yourself to us, including your name, address, telephone number, or email address. In the event that we learn that we have collected personal information from an individual under the age of seventeen, we will remove that information as quickly as possible. If you believe that we might have any information from or about a person under the age of seventeen, please contact us.

12. Contacting us and/or Challenging Compliance

If you have any questions about this privacy policy or our treatment of your personal data, please contact us.

We will inform individuals who make enquiries or lodge complaints about our enquiry or complaint procedures, as applicable. If a complaint is found to be justified, we will take appropriate measures, including, if necessary, amending our policies and practices.
